TERMS AND CONDITIONS FOR CONTRACTING AND USING IKI LOCKERS. LOCKER RESERVATION
CONTRACT.
In accordance
with the General Data Protection Regulation (GDPR), we inform you that your
data will be processed in our records for the purpose of maintaining and
fulfilling the relationship with our entity, which includes sending
communications within the scope of that relationship.
Additionally,
your data will be shared when necessary for the development, fulfillment, and
control of the relationship with our entity, or in cases authorized by law. In
accordance with the GDPR, you may exercise your rights by contacting MHIA
GOODS, SL (NIF B09623307), doing business as IKI LOCKERS, with an address at
Calle Aragón Un, 568, Local Comercial #3, 08026 Barcelona, and providing a
photocopy of your ID.
The content of
this communication, as well as any attached documents, is confidential and
intended exclusively for the recipient. If you are not the intended recipient,
we request that you notify us and do not share its content with third parties,
proceeding with its destruction.
The provider of
information society services must take into account that, in addition to the
information provided to service recipients through their "Privacy
Policy," they must also include additional legal texts related to other
mandatory regulations. These include, but are not limited to, general contracting
conditions, intellectual and industrial property rights, website usage
conditions, and liability provisions. Furthermore, they must comply with Law
34/2002 of July 11 on Information Society Services and Electronic Commerce, in
all its applicable provisions beyond Article 10 or to supplement the necessary
related information.
GENERAL
TERMS AND CONDITIONS FOR THE RENTAL AND USE OF IKI LOCKERS PURPOSE
These general
terms and conditions govern the rental of IKI LOCKERS (owned by MHIA GOODS SL)
through the website www.ikilockers.com, as well as their use. Additionally,
these terms regulate the contractual relationship between IKI LOCKERS (owner of
the lockers, MHIA GOODS) and the User who rents the IKI LOCKERS service.
SERVICE
IKI LOCKERS
offers Users the possibility to rent any of its lockers for full calendar days
(within the schedules offered by IKI LOCKERS).
What types
of lockers does IKI LOCKERS offer?
IKI LOCKERS
offers three types of lockers:

Classic:
40 cm high x 50 cm wide x 60 cm deep. Ideal for storing carry-on suitcases and
backpacks.
·
Grand:
50 cm high x 50 cm wide x 60 cm deep. Ideal for storing medium-sized suitcases.
·
Ultra:
90 cm high x 50 cm wide x 60 cm deep. Ideal for storing large suitcases.
What can a
User store inside their locker?
With the limits
established in this document (see the "Limits on Locker Use"
section), a User can store any items they wish, as long as they fit within the
specified dimensions and do not overload the locker.
How can a
User check if there are available IKI LOCKERS?
Through the
website www.ikilockers.com, the User can check the availability of lockers for
their desired dates.
For how long
can a locker be rented?
The User can
rent a locker for a minimum period of 1 day.
When can the
User access the rented locker(s)?
The locker
rental service is available for a full day, meaning the User can access their
reserved locker from 6:00 a.m. to 12:00 a.m. on the day of their reservation.
Once the
User has placed their belongings inside, can they only access the locker to
retrieve them?
No. IKI LOCKERS
provides a rental service that allows the User to access their rented locker as
many times as needed during the rental period. If the User forgets something or
needs to access their locker throughout the day, they can do so without any
issues within their reserved timeframe.
What is the
rental price per locker type/day?
The rental
price per locker is as stated on the website at the time of booking. The User
may benefit from any active promotions at that moment. All prices listed on the
website include VAT and apply to the rental of a locker (according to its size)
for a full calendar day.
How do the
lockers work?
The lockers
provided by IKI LOCKERS are fully automated. The User can make a reservation
through the website www.ikilockers.com, entering their personal details, the
number of lockers they wish to rent, the size, and the rental period.
Once the
booking is completed, the User will receive a confirmation with the reserved
locker number(s) and a security code to access them. The User will be able to
access their locker using the security code provided by IKI LOCKERS upon
reservation.
What should
the User do in case of an issue with the locker?
In the event of
a malfunction, lockout, or any other issue with the locker, the User can
contact IKI LOCKERS' assistance service by calling +34 690 661182 or sending an
email to info@ikilockers.com.
Can the User
modify, cancel, or obtain a refund for their reservation?
At IKI LOCKERS
S.L., we aim for customer satisfaction. Therefore, we offer the following
options:

Modify
the reservation:
Modifications must be made at least 24 hours before the start of the reserved
service. After this period, modifications will not be possible. Changes are
subject to locker availability at that moment and may involve an additional
cost due to banking fees.
·
Cancel
the reservation:
Cancellations must be made at least 24 hours before the start of the reserved
service. After this period, cancellations will not be possible. If a User has
any doubts about the cancellation policy or needs clarification, they can
contact info@ikilockers.com.
·
Obtain
a refund:
The refund will be processed once the cancellation has been verified. The User
will receive the refund through the same payment method used for the purchase,
within a maximum of 14 calendar days from the confirmed receipt of the
withdrawal request.
ACCESS AND
RESERVATION
To rent IKI
LOCKERS, the following requirements must be met:

The
User must be at least 16 years old.
·
The
User must accurately and truthfully complete the required fields in the
RESERVATION section of the website. This includes: full name, phone number,
email address, reservation date, rental period, number of lockers to be rented
(with size specifications), and payment details as required by the chosen
payment method.
·
The
User must accept the general terms and conditions for renting and using the
lockers.
·
The
User must accept the privacy policy of MHIA GOODS SL, the owner of IKI LOCKERS.
·
Once
the booking process is complete, the User will receive a reservation
confirmation via email. This confirmation will include the assigned locker
number(s), reserved date(s), and access codes for the locker(s).
USER
OBLIGATIONS. IMITATIONS ON LOCKER USE
By renting IKI
LOCKERS, the User agrees to the following conditions:

Proper
Use: Lockers must only be used to store the User’s personal belongings that
require temporary safe storage.
·
Secure
Closure: The User must ensure that the locker is properly closed before leaving
the facility, whether after inserting or removing items.
·
Prohibited
Use: Lockers may not be used for illegal or unauthorized purposes.
Specifically, Users must not store:
o
Stolen
goods, drugs, pornographic materials, or any items that are degrading to human
dignity.
o
Weapons
or any items requiring a license without possessing the required license.
o
Contaminants,
flammable objects, or hazardous substances.
o
Animals
or any living beings.
o
Perishable
food items (except for sealed, non-spillable food that does not stain lockers
or create odors).
·
Security
Code: The User must not share their access code with any third party. The User
is fully responsible for any consequences of failing to comply with this
obligation.
·
No
Third-Party Access: Lockers cannot be used to store items for collection by another
person. They are not to be used for transactions between individuals.
·
Limited
Time in the Facility: The User may only remain in the facility to access their
rented locker and must leave after retrieving or depositing items.
·
Timely
Removal of Belongings: All stored items must be removed by 12:00 a.m. on the
final rental day.
·
Locker
Condition: The locker must be left in the same condition as it was found. Any
issues should be reported to info@ikilockers.com.
·
No
Photography or Video Recording: The User must not take photos or videos inside
the IKI LOCKERS facilities, particularly of security mechanisms.
·
No
Valuables: Users should not store money, jewelry, or high-value electronics
(e.g., tablets, laptops, TVs). If they choose to do so, it is at their own
risk.
USER
LIABILITY AND CONSEQUENCES OF NON-COMPLIANCE
Failure to
Vacate the Locker on Time
In particular,
if the User does not empty the rented locker(s) on or before the rental
expiration date, MHIA GOODS SL will be authorized to access the locker(s) and
remove the stored items to free them up for regular use by other customers of
MHIA GOODS SL. In such a case, MHIA GOODS SL will temporarily store the items
and attempt to contact the User who has failed to vacate the locker on time to
arrange for the return of the items (the cost of which will be fully borne by
the User).
If 15 days pass
without successful contact with the User, or if the User fails to reach out to
MHIA GOODS SL and retrieve their items, it will be understood that the items
have been abandoned by the User. In this case, MHIA GOODS SL will cease storing
them and will dispose of them as deemed appropriate based on the nature of the
abandoned goods.
For each day
that passes after the rental expiration without the locker(s) being vacated, an
additional charge equivalent to the daily rental fee for the occupied locker(s)
will accrue. Additionally, a €100 penalty will be charged to the User, in
addition to any claims MHIA GOODS SL may make for actual damages and losses
incurred.
Unless the User
collects the items in person, MHIA GOODS SL might arrange for their shipment
after the User has paid the required fees to MHIA GOODS SL. The delivery will
be considered complete once MHIA GOODS SL hands over the items to the courier,
and MHIA GOODS SL will not assume any risks associated with the transportation
of the items.
The return
process will be initiated only after MHIA GOODS SL has received the User’s
payment for the applicable shipping costs, as outlined in the previous
paragraph. If 10 calendar days pass after MHIA GOODS SL has notified the User
in writing of the amount due, and the User has not made the payment, the items
will be considered permanently abandoned, and MHIA GOODS SL will proceed with
their disposal as previously specified for abandoned goods.
OBLIGATIONS
OF MHIA GOODS SL
MHIA GOODS SL
is committed to keeping the locker service active and providing the User with
the rented locker(s) in good working condition for the duration of the rental
period.
Additionally,
MHIA GOODS SL is obliged to resolve any issues related to the use of the
lockers as quickly as possible.
LIMITATION
OF LIABILITY OF MHIA GOODS SL
MHIA GOODS SL
provides a locker rental service but is not responsible for the safekeeping of
stored items. The User is solely responsible for the belongings placed in the
rented lockers.
COMPLAINTS
If the User
believes they have grounds for a complaint, they may do so by sending an email
to info@ikilockers.com.
MHIA GOODS SL
will attempt to resolve the issue and find a satisfactory solution for both
parties.
If the User is
not satisfied with the response from MHIA GOODS SL, they have the option to
submit a complaint to the consumer protection authorities of Catalonia.
APPLICABLE
LAW AND JURISDICTION
These General
Terms and Conditions are governed by Spanish law. Both parties agree to submit
to Spanish jurisdiction to resolve any disputes related to this contract.
